Regulations of the Ukrainian Catholic University UGCC Print

The foundation of the Ukrainian Catholic University (UCU) crowns more than one century of efforts and aspirations of the Ukrainian Greek Catholic Church and of Ukrainian scholarly elite to create a university that would grow on the grounds of Christian spirituality, culture and worldview and would become an educational and scholarly centre of world significance, as well as a centre for ecumenic dialogue and reconciliation in Ukraine. UCU is the inheritor and follower of the academic activity of the Greek Catholic Theological Academy founded  in 1928-1929 in Lviv by Metropolitan Archbishop Andrey Sheptytsky and headed by its first rector Rev. Joseph Slipy. The Academy being shut down in 1944 its mission and function were taken over by St Clement’s Ukrainian Catholic University in Rome organized and headed in 1963 by Metropolitan Joseph Slipy. In 1944 Lviv Theological Academy resumed its activity and in 1998 it gained recognition of the papal Congregation for Catholic education.

Borrowing its strength from the deep sources of Christian tradition, scholarship and culture, the Ukrainian Catholic University is called to perceive and process critically versatile aspects of human life, creative constituent of a human being and his/her ethic imperatives.


Academic and educational activity of UCU is concentrated around complex consideration of human essence, dignity and social dimension of his/her existence, pivoting upon the realization of significance of unity between high-level professionalism and developed Christian worldview, openness of a human person to transcendence and to interpersonal dialogue of faith and love.

Christian identity of the university which grows on the ground of spiritual and theological traditions of eastern Christianity is getting stronger and developing in a continuous ecumenic dialogue with other Churches and religions in Ukraine and worldwide.

 

Chapter 1. General principles

1.1. Ukrainian Catholic University of the Ukrainian Greek Catholic Church (further on referred to as “the University”) is a spiritual educational institution of the Ukrainian Greek Catholic Church which functions by the blessing of UGCC Head (Chief Archbishop) and whose founder is Metropolia of Kiev-Halych of the Ukrainian Greek Catholic Church.

1.2. The University is a high educational and scholarly institution cherishing Philosophy, Theology and other humanities related to them.

1.3. The University is the inheritor and follower of educational and scholarly activity of the Greek Catholic Theological Academy founded in 1928-1929 in Lviv by Metropolitan Andrey Sheptytsky and of the St Clement’s Ukainian Catholic University founded by Patriarch Joseph Slipy in 1963 in Rome.

1.4. The University if a legal successor of Lviv Theological Academy of the Ukrainian Greek Catholic Church created by the Chief UGCC Archbishop in 1994 in Lviv.

1.5. The activity of the University is regulated by the effective legislation of Ukraine, Canon Law and these very Regulations.

1.6. The University is a juridical person with its own balance, seals, letterheads, symbols, and other attributes; it owns, uses and disposes of its own property; has its current (demand deposits), foreign currency and other accounts in banks.

1.7. The full name of the University – Ukrainian Catholic University of the Ukrainian Greek Catholic Church.

1.8. Shortened name of the University – Ukrainian Catholic University.

1.9.  Juridical address of the University: 79011, Lviv, Sventsitskoho Str., 17.

 

Chapter 2. Goal and main targets of the University

2.1. The goal and main targets of the University are:

to favour development of philosophy and theology scholarship and other related to them disciplines with simultaneous recommencement of Theology in the system of scholarly disciplines in Ukraine;

to prepare qualified experts and scholars; priests;

to organize and conduct fundamental and applied scholarly researches with a deepened expertise of eastern theology sources;

to cooperate with the Church and various social institutions;

to cherish intellectual life of the Church, to favour a complex comprehension of Christian worldview.

 

Chapter 3. Structure of the University

3.1. Structural subdivisions of the University are educational faculties, scholarly institutes, chairs, departments, library, publishing centre and other educational, scholarly and assisting subdivisions which carry out their activity on the basis of corresponding Statute affirmed by the Rector of the University.

3.2. The activity of scholarly institutes is managed by directors appointed by the Rector.

3.3. The activity of chairs and departments is managed by their heads appointed by the Rector, according to the recommendations of corresponding deans.

3.4. The faculties are managed by deans appointed according to these very Regulations.

 

Chapter 4. Managing the University

4.1. Managing bodies of the University are: Chancellor Magnus, Rector, Academic Council of the University.

4.2.  Chancellor Magnus

4.2.1. Chancellor Magnus of the University is the Head (Chief Archbishop) of the Ukrainian Greek Catholic Church.

4.2.2. Chancellor Magnus represents the University before all local self-governed Churches favouring thus its unity with the whole Church.

4.2.3. Authority of the Chancellor Magnus:

4.2.3.1. in cooperation with the leaders of the University and its faculty supervises consistency with the Christian doctrine and discipline;

4.2.3.2. approves University Regulations, ammendments and additions to it;

4.2.3.3. interprets University Regulations with credibility;

4.2.3.4. appoints the Rector;

4.2.3.5. issues or cancels the canonic nomination “missio canonica” for professors teaching the disciplines relevant to faith and morality;

4.2.3.6. periodically examines the report about the current situation in the University;

4.2.3.7. supervises and favours financial and economic activity of the University;

4.2.3.8. proposes questions to be considered in all leading bodies of the University;

4.2.3.9. takes decision about reorganization or liquidation of the University.

4.2.3. Under certain circumstances Chancellor Magnus can delegate some if His powers to Rector.

4.3. Rector of the University

4.3.1. The top leading person in the University is Rector who heads and represents the University.

4.3.2.   Authority of the Rector:

4.3.2.1 heads and manages the University while coordinating the work of various faculties and institutes;

4.3.2.2. calls the Academic Council of the University, presides at its sessions and implements its decisions;

4.3.2.3. appoints vice-rectors, deans, professors, heads of the University chairs;

4.3.2.4. solves all inner contradictions within the University;

4.3.2.5. participates in and proposes questions for discussion at the Academic Council of the University and its faculties;

4.3.2.6. submits annual written report to Chancellor Magnus about current situation in the University; creates, reorganizes and liquidates faculties, institutes, chairs, departments, centres and other educational, scholarly and assisting subdivisions of the University, as well as improves management and introduces changes to the University structure;

4.3.2.7. approves the University budget;

4.3.2.8. acts on behalf of the University and represents it without warrant in all organizations, institutions and enterprizes; by His power of attorney other people can represent the University;

4.3.2.9. opens accounts of the University in banks, manages all costs of the University;

4.3.2.10. within His authority and competence issues decrees, orders, instructions and other acts obligatory for all staff members and students of the Unversity;

4.3.2.11. forms staff list, determines salary rates of the University staff members, introduces changes to them;

4.3.2.12. employs and dismisses University staff members by making with them a contract or an emloyment agreement;

4.3.2.13. admits and expels students and visiting students of the University;

4.3.2.14. executes agreements and other acts on behalf of the University;

4.3.2.15. approves normative documents, annual work programs and scholarly reasearch plans of the University;

4.3.2.16. approves work programs and plans for scholarly research of the faculties, institutes and other independent subdivisions and organizations that belong to the University;

4.3.2.17. approves functional duties of the University staff members;

4.3.2.18. keeps control over the precise and accurate implementation of educational, scholarly and methodological, productive and other duties by the employees and students;

4.3.2.19. implements measures of encouragement and disciplinary imposition of salary in regard to the University employees, according to a set procedure;

4.3.2.20. solves other questions of organizing educational process and carrying administrative and economic activity of the University;

4.3.2.21. makes decisions about creation, reorganization and liquidation of separate structural subdivisions, affiliated enterprises of the University, as well as about University’s participation in economic communities.

4.3.3. Rector of the University is appointed by the Chancellor Magnus for a 5-year term.

4.4. Academic Council of the University.

4.4.1. Academic Council is a collegiate body of University management which considers questions of scholarly and academic activity of the University.

4.4.2. Academic Council includes: Rector, vice-rectors, leaders of scholarly structural subdivisions of the University, faculty deans, two representatives elected from professors of each faculty and one representative elected from students of each faculty. The personal membership in the Academic Council is approved by Rector’s decree. By his decree Rector can deprive of Academic Council membership those members who terminated their employment in the University or are on a long-term business or academic trip, those who were members of the Academic Council according to their position but were dismissed from it, also students who terminated their studies. Academic Council is effective for the term of two years.

4.4.3. Rector is the head of the Academic Council. During the first session of the Academic Council the Secretary of the Academic Council (Academic Secretary of the University) is elected from amongst its members. He conducts sessions of the Academic Council in case of Rector’s absence. Academic Council sessions are called by Rector, usually, once a month. The process of considering various questions and the decisions taken by the Academic Council are recorded in the protocols of Academic Council sessions signed by the Head and the Secretary of the Academic Council. Decisions of the Academic Council are implemented by issuing corresponding Rector’s decrees and orders.

4.4.4. The Academic Council competence includes:

4.4.4.1. Listening to the reports of faculty deans, directors of scholarly research institutes and heads of other structural subdivisions about their educational and methodological work;

4.4.4.2. Considering questions about opening, reorganization and liquidation of structural subdivisions of the University that carry out scholarly and educational activity, submitting corresponding recommendations to the Rector;

4.4.4.3. Taking decision about opening, reorganization and liquidation of new specialities and specializations within the framework of already existing faculties and programs, and submitting it for approval to the Rector;

4.4.4.4. Preliminary examination of the University’s documents relevant to its academic and scholarly activity;

4.4.4.5. Awarding academic titles of elder scholar, docent and professor.;

4.4.4.6. Awarding the scholarly degree of doctor honoris causa and other honourable titles of the University;

4.4.4.7. Submitting scholarly works of the University scholars for obtaining prizes, promoting candidates among University staff members for awarding honourable titles and awards, recommending candidates for election into academies and scholarly communities;

4.4.4.8. Establishing nominal sholarships and recommending candidates for receiving nominal and special scholarships.

4.5.  Dean

4.5.1. A faculty dean organizes, coordinates and controls academic, scholarly, methodological and economic activity of the faculty. Dean is appointed by Rector of the University by the recommendation of competitive employment comission, with preliminary approval of the Academic Council, for the term of 5 years. Deputy deans are appointed by Rector, with recommendation from a dean, for the term of the dean’s authority..

4.5.2. Dean’s Authority:

4.5.2.1. acts on behalf of the faculty, represents it in all bodies, organizations and institutions within his/her authority and expertise;

4.5.2.2. organizes the activity of faculty and manages it;

4.5.2.3. within his/her authority introduces proposals to the Rector regarding issuing decrees and orders;

4.5.2.4. coordinates development of academic plans and curricula, organizes educational process at the faculty, controls the quality of education;

4.5.2.5. developes a perspective plan of the faculty development;

4.5.2.6. together with heads of chairs forms the academic faculty of the faculty;

4.5.2.7. by agreement with chairs plans time-table and amount of work for the faculty members, submits it for approval to the Rector;

4.5.2.8. submits to the Rector projects of decrees about admission of students to the University, awarding scholarships, giving academic leave and expelling students prior the end of their studies;

4.5.2.9. submits to the Rector proposals regarding appointments of heads of chairs and departments of a particular faculty;

4.5.2.10. forms a package of proposals for future employment of the faculty graduates;

4.5.2.11. carries out other measures provided by the Statute of the faculty and the Regulations of the University.

4.6. Faculty Academic Council

4.6.1. Faculty Academic Council is created within each faculty. It consists of a dean, its deputies, heads of chairs, as well as of representatives from professors and students of the faculty. Quota of representatives from professors and students is fixed by the Rector with recommendation of the faculty’s dean. The personal list of a Faculty Academic Council is approved by the Rector with the corresponding dean’s recommendations. The effective term of each Faculty Academic Council is two years.

Faculty Academic Council deals with questions of academic, methodological, scholarly and economic activity of the faculty and its logistics, hears reports about the work of postgraduate students, doctorants, professors and faculty staff members, initiates researches and economic activity, submits ptoposals about awarding academic titles to professors and faculty staff members.

 

Chapter 5. Organization of educational process in the University

5.1. Organization of the educational process in the University is determined by the inner documents of the University.

5.2. Participants of the educational process in the University are visitng students, students, postgraduates, doctorants, external students, pedagogical and scholarly staff, managers of academic subdivisions and other people who study or teach at the University.

5.3. Students of the University have right to:

5.3.1. obtain education by full-time and part-time studying programs, as well as other programs;

5.3.2. use rights and privileges of postponing military service, tax benefits, considering the period of studies as part of job seniority according to the order and prerquistites defined for students and pupils of the state educational institututions;

5.3.3. obtain a second education on the level of agreement with the University.

5.4. Students of the University are obliged to:

5.4.1. follow effective legislation of Ukraine and Christian moral norms, respect religious feelings of other people;

5.4.2. systematically and conscientiously master the knowledge and practical professionsl skills;

5.4.3. follow the items of the Statute and internal documents of the University, study according to the curricula;

5.5. University students may have other rights and duties according to this Statute, internal documents of the Univesity and effective legislation;

5.6. Student may be expelled from the University for the following reasons:

5.6.1. submitting an application about expelling by one’s own wish;

5.6.2.   impossibility to continue studies due to the sate of health which must be confirmed by a special conclusion of medical qualified commission;

5.6.3. academic failure (failed credits and examinations);

5.6.4. failure to meet the demands of curricula or academic schedule;

5.6.5. improper behaviour, rude violation of moral norms, academic discipline and regulations of the internal schedule of the University;

5.6.6. failed graduation examinations, diploma (qualification) paper not defended, failure to be present at the graduation examinations or the procedure of defence of the diploma (qualification) work.

5.7. Teaching staff members of the University have the following rights to:

5.7.1. choose freely forms, methods and tools of teaching and express pedagogic initiative on the basis of the University goals and objectives;

5.7.2. improve qualification in a free choice of programs, education forms, educational institutions, agencies and organizations which carry requalification and promotion of high education teaching personnel;

5.7.3. have social guarantees and privileges according to the effective legislation;

5.7.4. use other rights provided by the effective legislation of Ukraine and internal documents of the University.

5.8. University teaching staff members are obliged to:

5.8.1. improve their rofessional level and pedagogic skills;

5.8.2. ensure a high scholarly and theoretical level of teaching subjects in the full size of the educational program within a relevant speciality, strive for the best mastering of expertise from the side of the students  and other people studying at the University, favour development of their capabilities;

5.8.3. educate in students respect for truth and Christian moral principles;

5.8.4. strengthen themselves in moral virtues and realize the role and significance of Christian life;

5.8.5. foster students in the spirit of peace, mutual understanding, based on Christian heritage and traditions of ecumenic dialogue and openness;

5.8.6. to develop respect for the principles of Christian morality by means of instruction and by their own (i.e. teachers’) example;

5.8.7. follow the priciples of pedagogic ethics, respect dignity of all participants of the education process.

5.9. Teaching staff members are employed by competitive bid, and they work under the conditions of an employement agreement. The procedures of hiring and dismissal of the teaching staff members is determined by the inner University documents and effective legislation of Ukraine.

5.10. Rights and duties of the members of the educational auxiliary and administrative staff are determined by inner University documents and effective legislation of Ukraine.

5.11. The University provides proper conditions for educational process, work and rest of the people participating in it.

 

Chapter 6. University employees, their rights and obligations

6.1. University employees are: professors, educational auxiliary and adminitrative personnel.

6.2. University employees have right to:

6.2.1. participate in solving problems related to educational, scholarly and economic activity of the University in accordance with the Statute;

6.2.2. elect and be elected to the managing bodies and bodies of the University self-government;

6.2.3. use the property intended for collective usage, according to the regulations postulated by the University;

6.2.4. receive material and other kinds of aid, right for rest and health care.;

6.2.5. work by contract, including parallel employment in other institutions;

6.2.6. get united into communities, unions, associations, fraternities, clubs and other organizations;

6.3. University employees are obliged to:

6.3.1. follow the Statute and Regulations of the inner University schedule;

6.3.2. comply with decisions of the University ruling bodies;

6.3.3. improve the level of expertise, execute their official duties;

6.3.4. be careful with the Unversity property;

6.3.5. cherish ans enrich traditions of the University.

 

Chapter 7. Legal, economic and other principles of the University activity, international cooperation

7.1. For the implementation of the set tasks the University has right to:

7.1.1. resolve questions related to educational, scholarly, publishing and economic activity of the University;

7.1.2. carry out financial and economic activity; execute the duties, be a claimant and defendant at court, in economic court or arbitration tribunal;

7.1.3. be founder or shareholder of enterprises, economic communities, associations and other units, to create subsidiaries, according to the active legislation;

7.1.4. conclude agreements and other acts with enterprises, organizations, institutions, citizens, according to the active legislation of Ukraine;

7.1.5. enter international unions, international associations, and funds, develop international contacts and connections, and conclude respective agreements;

7.1.6. aiming at the implementation of its statute activity, to obtain and alienate movable property and realty, securities and shares; own, use and dispose them, according to the active legislation of Ukraine;

7.1.7. use loans and credits provided by banks and other creditors;

7.1.8. accomplish capital construction and reconstruction, major repairs of the main funds via work by contract or via inner economic activity.

7.2. The University has right to develop international contacts, in accordance with to the active legislation of Ukraine.

7.3. The University carries out the following types of international activity:

7.3.1. establishes direct contacts with educational and scholarly institutions, organizations, foundations, etc. in foreign countries;

7.3.2. within a strictly defined order concludes agreements and other acts of international collaboration;

7.3.3. engages scholars from abroad into teaching and research activity at the University, as well as into the realization of its educational and scholarly programs, and sends its staff members to foreign educational institutions and organizations;

7.3.4. engages foreign institutions into the development of the University; also attracts donations in both native and foreign currency;

7.3.5. establishes grants and rewards for prominent achievements in the development of academic scholarship.

7.4. Foreign currency incomings are set down to foreign-currency-denominated account of the University and are used in accordance with the active legislation of Ukraine.

 

Chapter 8. Property and Finances of the University

8.1. Property of the University consists of main funds and floating assets, as well as of other values whose cost is reflected in the independent balance of the University.

8.2.  Property and finances of the University are being formed from:

8.2.1. means and costs of the Ukrainian Greek-Catholic Church;

8.2.2. costs received for preparation, promotion and re-qualification of cadres, according to concluded agreements;

8.2.3. costs for providing additional educational services;

8.2.4. voluntary payments, charitable donations including those from abroad, material values received from enterprises, institutions, organizations, citizens;

8.2.5. other sources not prohibited by the active legislation of Ukraine.

 

Chapter 9. Changes and Amendments to the University Statute

9.1. Changes and amendments to the University statute are approved by the Great Chancellor from his own initiative or by recommendation of Rector, and are registered according to the procedures provided by law.

 

Chapter 10. Re-organization and liquidation of the University

10.1. Reorganization and liquidation of the University is carried into practice by the decision of Great Chancellor from his own initiative or by recommendation of Rector.

10.2. In case of decision to liquidate the University the Great Chancellor determines the lot of the University’s property which will be passed over to a non-governmental organization.
